Case for 90 day detention is legal nonsense - Howarth

November 15, 2005 11:16 AM

David Howarth, MP for Cambridge, has released new evidence in his intervention in the Report Stage of the Terrorism Bill in the House of Commons to condemn the need for primary legislation to provide for a 90 day detention of terrorist suspects as legally pointless.

Commenting on this new evidence, David said:

"There is no legal basis for the idea of a rule against questioning a suspect after charge, except for one which the Home Secretary can re-write himself at any time.

"This makes the supposed 'need' to detain terrorist suspects for 90 days without charge simply nonsense."
